A heart-rending case has emerged from Dehradun, where an elderly couple was forced to fight for their rights after their own son sought to throw them out of the house.
Sardar Paramjit Singh and his wife Amarjit Kaur had generously transferred their 3,080 sq ft property—comprising two large halls—to their son, Gurvinder Singh, through a gift deed. This deed was not unconditional: it clearly stated that the son would maintain his parents, live with them, and ensure that their grandchildren remained in contact with them.
However, once the property was in his name, Gurvinder Singh disregarded both his moral duties and the legal conditions of the gift deed. He began forcing his parents out of the house and even barred them from meeting their grandchildren.
Helpless, the elderly couple ran from the tehsil office to the police station and even approached the lower courts, but to no avail. In their search for justice, they finally knocked on the doors of District Magistrate Savin Bansal.
Swift action by DM Bansal under the Maintenance and Welfare Act
Taking immediate cognizance of the matter under his special powers conferred by the Maintenance and Welfare of Parents and Senior Citizens Act, DM Bansal thoroughly heard the case. Despite repeated notices and public announcements, Gurvinder Singh failed to appear or file any objections.
Gift deed cancelled in the first hearing itself
Given the blatant violation of all the conditions of the gift deed, the District Magistrate ordered its cancellation in the very first hearing. The property was duly restored to the names of Paramjit Singh and Amarjit Kaur.
Overcome with emotion, tears rolled down the cheeks of the elderly couple upon hearing the DM’s order—finally securing them the justice and dignity they deserved.
